Rochester Man Convicted of Child Pornography Charges

A 56-year-old Irondequoit man has been convicted of distributing and possessing child pornography, following a jury trial in U.S. District Court. Robert Cavigliano was found guilty on five counts of distributing child pornography, one count of possessing child pornography, and one count of making a false statement to federal agents.

The charges against Cavigliano carry a mandatory minimum sentence of five years in prison, a maximum of 20 years, and a fine of $250,000. Sentencing is scheduled for June 10, 2014, at 3:00 p.m. before U.S. District Judge Frank P. Geraci, Jr.

According to court documents, undercover agents in both Rochester, N.Y. and Montana received child pornography from Cavigliano through a peer-to-peer software program in October and November 2011. Agents executed a search warrant at Cavigliano’s residence in January 2012, and located a laptop computer that contained images and videos of child pornography.

During an interview with FBI agents prior to the execution of the warrant, Cavigliano made a false statement when he claimed not to own or possess any laptop computers. This statement was found to be false when the laptop was discovered during the search of his residence.

The case against Cavigliano was brought as part of Project Safe Childhood, a nationwide initiative designed to protect children from online exploitation and abuse. The initiative is led by the U.S. Attorneys’ Offices and marshals federal, state, and local resources to better locate, apprehend, and prosecute individuals who exploit children via the Internet.

Cavigliano’s conviction is the culmination of an investigation by the Federal Bureau of Investigation’s Cyber Task Force, consisting of Special Agents of the Federal Bureau of Investigation, Deputies with the Monroe County Sheriff’s Office, and Investigators with the Rochester Police Department.
