Juan Martinez-Castaneda, a 54-year-old Mexican national, has been charged with a serious crime that puts national security at risk. Martinez-Castaneda, also known as ‘Fernando A. Lopez’, ‘Juan C. Martinez’, ‘Oscar Flores’, ‘Martin Peralta’, and ‘Juan Castaneda’, was charged on August 4, 2022, in a one-count indictment for illegal re-entry of a removed alien in violation of Title 8, United States Code, Section 1326(a).
According to the indictment, Martinez-Castaneda reentered the United States after he was previously deported on February 3, 2003. This is a clear disregard for U.S. immigration laws and poses a significant threat to national security.
The U.S. Attorney Duane A. Evans announced the indictment, warning that Martinez-Castaneda faces a maximum term of imprisonment of two years, a maximum fine of up to $250,000, a maximum term of supervised release of up to one year, and a mandatory $100 special assessment fee.
U.S. Attorney Evans emphasized that an indictment is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt. The U.S. Attorney’s Office will work tirelessly to ensure that justice is served.
Assistant U.S. Attorney Carter K. D. Guice, Jr. is in charge of the prosecution. The U.S. Immigration and Customs Enforcement has been praised for their work in investigating this matter.
