ALBANY, NEW YORK – The grimy streets of Whitehall are echoing with the 15-year sentence handed down to Kevin Smurphat, a sex offender who has now been added to the federal registry for child pornography offenses.
Smurphat, aged 35, was today sentenced to 15 years behind bars followed by an additional 15 years of supervised release. The Whitehall native was caught with a cellphone, which he used to upload explicit images of minors to a file-sharing service and to join a group chat where he swapped child pornography.
This is no mere parolee’s misstep; Smurphat has a previous conviction for sex offenses. His latest transgression came while on state parole in November 2020, when he brazenly continued his sinister activities online.
United States Attorney Carla B. Freedman and FBI Special Agent Craig L. Tremaroli broke the news of this despicable sentence. Smurphat was also ordered to pay a total of $7,000 in restitution to his unnamed victims, a paltry sum for the lifetime damage he has caused.
The investigation into Smurphat’s case was part of Project Safe Childhood, an initiative launched by the Department of Justice to combat online exploitation of children. Assistant United States Attorney Dustin C. Segovia led the prosecution of this case with vigor and determination.
