Earl Landon Old Chief Jr, Assault on BIA Officer, Montana 2024

BILLINGS — The grim streets of Lodge Grass witnessed a sentencing today that echoed through the Crow Indian Reservation. Earl Landon Old Chief, Jr., 36, stood before U.S. District Judge Susan P. Watters, receiving a one-year prison term followed by three years of supervised release for assaulting a Bureau of Indian Affairs (BIA) officer.

The assault unfolded on March 14, 2021, as BIA officers pursued Darnell Lee Not Afraid, who was driving a stolen truck at breakneck speeds through Lodge Grass neighborhoods. Not Afraid’s escape ended at a residence where he confronted the pursuing officer, leading to a shooting. Amidst the chaos, Old Chief reportedly joined the fracas, pointing the officer’s Taser and throwing it at his head.

Old Chief pleaded guilty to assault on a federal officer in September 2022. The incident was marked by anger and tension following the shooting of Not Afraid, who was later sentenced to five years for possession of a firearm in furtherance of assault on a federal officer. Darwyna Caylynn Catherine Bullshows faced no additional punishment after her conviction in the case.

U.S. Attorney Jesse Laslovich emphasized the gravity of Old Chief’s actions, stating that such violence against law enforcement officers cannot be tolerated. The judge’s decision underscores the serious consequences for those who threaten the safety of public servants and community members alike.
