Davon Lymon, Unlawfully Possesses Firearm, New Mexico 2015

ALBUQUERQUE – Federal Judge M. Christina Armijo has found 35-year-old Davon Lymon guilty of unlawfully possessing a firearm, which he used in the tragic shooting of Albuquerque Police Officer Daniel Webster on October 21, 2015.

Lymon was convicted on Count 4 of a four-count indictment, stemming from an incident that led to Officer Webster’s death on October 29, 2015. U.S. Attorney Damon P. Martinez emphasized the office’s commitment to protecting law enforcement officers and ensuring justice for their families.

Special Agent in Charge Thomas G. Atteberry of the ATF called Officer Webster a ‘hero’ and expressed hope that the guilty verdict provides comfort to his family. Albuquerque Police Department Chief Gorden E. Eden Jr. thanked the U.S. Attorney’s Office for their work, noting that today’s verdict brings them closer to justice for Officer Webster.

Lymon, who has prior convictions for voluntary manslaughter, aggravated battery, and fraud, faces a maximum of ten years in federal prison for the firearms charge. The trial for Counts 1 through 3 is yet to be scheduled, while Lymon’s sentencing hearing for his heroin trafficking case has not been set.

In the other federal case, Lymon was charged with distributing heroin and possessing a firearm in connection with that offense. He pled guilty on May 9, 2016, without a plea agreement, and faces a maximum of 20 years in prison following sentencing.
