Mission Man Charged With Aggravated Sexual Abuse

A federal grand jury has indicted Frederick Leo Marshall, a 56-year-old Mission man, for Aggravated Sexual Abuse, Assault with a Dangerous Weapon, Assault Resulting in Serious Bodily Injury, and Child Abuse.

The indictment, handed down on December 9, 2014, alleges that Marshall knowingly engaged in a sexual act with a female victim on or about October 30, 2014, and also assaulted her with a sword, resulting in serious bodily injury. The same day, he allegedly abused, exposed, tortured, tormented, and cruelly punished four minor victims.

The maximum penalty upon conviction is up to life in prison and/or a $250,000 fine, not less than 5 years of supervised release, and $700 to the Federal Crime Victims Fund. Restitution may also be ordered.

Marshall appeared before U.S. Magistrate Judge Mark A. Moreno on December 15, 2014, and pled not guilty to the indictment. He was remanded to the custody of the U.S. Marshals Service pending trial.

The investigation is being conducted by the Federal Bureau of Investigation and the Rosebud Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Tim Maher is prosecuting the case.

Marshall’s trial date has not been set. The charges are merely accusations, and he is presumed innocent until and unless proven guilty.
