Francis DuBray, a 24-year-old Mobridge man, has been charged with distribution of a controlled substance in federal court. The indictment, handed down by a federal grand jury on August 21, 2013, alleges that DuBray knowingly and intentionally distributed marijuana, a Schedule I controlled substance, on multiple occasions.
The maximum penalty upon conviction is not more than 5 years of imprisonment and/or a $250,000 fine, a mandatory period of at least 2 years of supervised release, an additional year of supervised release upon revocation, and a mandatory $100 special assessment to the Federal Crime Victims Fund. Restitution may also be ordered.
According to court documents, DuBray appeared before U.S. Magistrate Judge Mark A. Moreno on September 19, 2013, and pled not guilty to the indictment. The investigation is being conducted by the Northern Plains Safe Trails Drug Enforcement Task Force, with Assistant U.S. Attorney Kathryn N. Rich handling the prosecution.
U.S. Attorney Brendan V. Johnson announced the charges, stating that the case is a reminder of the ongoing efforts to combat drug trafficking in the region. The Northern Plains Safe Trails Drug Enforcement Task Force has been working tirelessly to disrupt and dismantle drug trafficking organizations in the area.
The charge is merely an accusation, and DuBray is presumed innocent until and unless proven guilty. A trial date has been set for November 19, 2013, and DuBray was remanded to the custody of the U.S. Marshals Service pending the trial.
