Physician Charged for Misbranded Medication Scam
A local Daviess County, Kentucky medical physician has been charged with misbranding and unapproved drugs, a crime that could land him behind bars for up to a year and cost him $1001,000 in fines and penalties.
According to Acting United States Attorney John E. Kuhn, Jr., Randall Edward King, MD, age 56, of Women’s Healthcare in Owensboro, Kentucky, was charged by an information in Owensboro on June 17, 2015.
The alleged crime began when King imported intrauterine devices (IUDs) from the United Kingdom. What the FDA found troubling was that the IUDs were not approved for use by the U.S. Food and Drug Administration (FDA). Furthermore, the labeling on the IUDs was not in the English language, making it unlikely that the labels would be read and understood by the ordinary individual under customary conditions of purchase and use.
The FDA investigation showed that King billed Medicaid $68,171.34 for the misbranded IUDs, further fueling the allegations of a scam. This case is being prosecuted by Assistant United States Attorney David Weiser and is being investigated by the FDA – Office of Criminal Investigations.
It is worth noting that the indictment of a person by a Grand Jury is an accusation only, and that person is presumed innocent until and unless proven guilty.
King could face significant penalties if convicted at trial. He could be sentenced to no more than one year in prison, ordered to pay a fine of $1,000 and to serve a one year period of supervised release.
