Rapid City Man Gets 12 Months for Sex Offender Registration Snafu
Wilbur Toledo Flute, 39, is going to prison for a year and a day for his failure to register as a sex offender in Rapid City, South Dakota.
Flute, who was indicted for Failure to Register as a Sex Offender by a federal grand jury on March 19, 2013, was sentenced to 12 months and one day of imprisonment by Chief Judge Jeffrey L. Viken, U.S. District Court, on July 10, 2013. In addition to his prison time, Flute was ordered to serve 5 years of supervised release and pay $100 to the Federal Crime Victims Fund.
According to court documents, Flute failed to update his sex offender registration from November 28, 2012, to February 27, 2013. He pleaded guilty to the charge on April 12, 2013.
The case was investigated by the U.S. Marshals Service, with Assistant U.S. Attorney Eric Kelderman prosecuting the case.
Flute was immediately turned over to the custody of the U.S. Marshal following his sentencing, bringing an end to a case that highlights the importance of adhering to registration requirements for sex offenders.
