Schenectady Man Charged With Receipt and Possession of Child Pornography

A 47-year-old Schenectady man, Harry Gates, has been charged with receipt and possession of child pornography after allegedly downloading over 600 files onto his home computer.

The U.S. Attorney’s Office announced that Gates faces a two-count criminal complaint in the Northern District of New York. If convicted, he could face up to 20 years in prison on the receipt charge and up to 10 years on the possession charge, as well as a maximum fine of $250,000.

Gates is being held without bond pending his preliminary hearing, scheduled for December 10, 2013, at 1:30 p.m. before U.S. Magistrate Judge Christian F. Hummel.

According to the complaint, Gates allegedly searched for and downloaded hundreds of still image and video files of child pornography between February 2012 and November 22, 2013, using the Internet and file sharing programs.

Homeland Security Investigations is leading the investigation, and Assistant U.S. Attorney Rick Belliss is prosecuting the case.

The charge against Gates is merely an accusation, and he is presumed innocent until proven guilty.

The Northern District of New York takes these types of cases very seriously, and this prosecution sends a strong message that child pornography will not be tolerated in our communities.
