Juan Manuel Tena, Alien Smuggling Conspiracy, Texas 2024

BROWNSVILLE, Texas – A ruthless alien smuggling operation allegedly led by Juan Manuel Tena, 39, of Pharr, Texas, has left a trail of death and despair along the southern border. Federal authorities announced the arrests of six individuals this week, all facing charges related to a conspiracy that resulted in the deaths of eight migrants and serious injuries to two others.

Those taken into custody alongside Tena include Julia Isairis Torres, 37, Israel Torres Jr., 33, Erasmo Garcia III, 21, and Alexis Rafael Adorno, all of Roma, Texas, as well as Jose Refugio Torres, 26, of Austin. The 11-count indictment, returned January 10th and unsealed with the arrests, paints a grim picture of a callous network exploiting vulnerable people for profit. The indictment alleges Tena coordinated the smuggling operation across the Southern District of Texas.

The charges stem from two separate, disastrous smuggling attempts. In March 2019, Tena, Julia Torres, Israel Torres, Jose Torres and Garcia allegedly attempted to transport illegal aliens by motor vehicle from the Rio Grande Valley to Houston. The attempt failed catastrophically, resulting in a vehicle rollover that killed four non-U.S. citizens and seriously injured another. Nearly three years later, in February 2022, Tena and Adorno allegedly attempted to smuggle individuals by watercraft from South Padre Island to the Corpus Christi area. This time, the watercraft capsized, claiming the lives of four more migrants and leaving another seriously wounded.

All six defendants are charged with conspiracy to transport illegal aliens resulting in death, and multiple counts of transporting illegal aliens resulting in death. If convicted, they each face a potential life sentence and a maximum fine of $250,000 for the conspiracy charge alone. Each count of transporting illegal aliens resulting in serious bodily injury carries a potential sentence of up to 20 years in prison. The indictment also includes a notice of forfeiture, signaling authorities intend to seize properties allegedly purchased with the proceeds of this criminal enterprise.

The investigation, dubbed Operation Justice for All by Homeland Security Investigations (HSI), was a massive collaborative effort. Border Patrol, the Coast Guard, Customs and Border Protection’s Air and Marine Operations, and multiple local law enforcement agencies – including police departments in Port Mansfield and South Padre Island, the Texas Rangers, Texas Game Wardens, and sheriff’s offices in Kenedy, Duval and Willacy Counties – all contributed to bringing these individuals to justice. The Willacy County District Attorney’s Office also provided assistance.

Assistant U.S. Attorneys Edgardo J. Rodriguez and David A. Lindenmuth are prosecuting the case. It’s crucial to remember that an indictment is merely a formal accusation, and all defendants are presumed innocent until proven guilty beyond a reasonable doubt through due process of law. But the evidence, as laid out by federal prosecutors, suggests a pattern of reckless disregard for human life in pursuit of illicit profit.
