Union Boss Steals from Own Members
Malvin Bergeron, the 63-year-old president of the Local 537M Graphic Communications Union, was sentenced to four years of probation for embezzling union funds, announced U.S. Attorney Dana Boente yesterday.
According to court records, Bergeron embezzled $4,041.88 from the union account by writing, endorsing, and cashing checks made payable to himself personally that were not authorized by the Union’s by-laws. The Local 537M maintained a checking account with a local bank to hold the membership dues collected from the union members.
As the union’s president, Bergeron had access to the funds in the union account through checks. The embezzlement occurred between November 2004 and May 2011, during Bergeron’s tenure as president.
The case was investigated by the U.S. Department of Labor and prosecuted by Assistant U.S. Attorney Spiro G. Latsis. Bergeron was ordered to pay restitution in the amount of $4,041.99 as well as a $3,000.00 fine.
U.S. District Judge Ivan L.R. Lemelle handed down the sentence, imposing four years of probation on Bergeron. The sentence was seen as lenient by many, considering the severity of the crime.
When questioned about the sentence, U.S. Attorney Boente stated, ‘The sentence handed down by the court reflects the seriousness of the offense, while also taking into account Bergeron’s age and lack of prior convictions.’
However, many union members and labor activists have expressed outrage over the sentence, stating that Bergeron’s actions were a betrayal of the trust placed in him by the union members.
