New York – It’s a grim reminder of the dangers posed by realistic-looking toys as New York Attorney General Letitia James announced that retail giant Walmart will pay $14,000 for shipping illegal toy guns to the state. The OAG investigation revealed that third-party sellers on Walmart’s online platform sold nine such imitation firearms to New Yorkers.
The banned toy guns are those that are black, dark blue, silver, or aluminum-colored and resemble real guns. These can be easily mistaken for genuine weapons, leading to serious incidents. Under New York law, retailers face fines up to $1,000 per violation when selling realistic-looking toys.
Attorney General James stressed the necessity of this ban, “Realistic-looking toy guns can put communities in serious danger. Walmart’s failure to prevent its third-party sellers from shipping these items is a clear violation of our laws.”
The investigation by OAG also found that Walmart itself shipped nine of these imitation firearms via its fulfillment services to addresses across New York, including New York City and Western New York.
As part of the settlement, Walmart must pay $14,000 in penalties and ensure its third-party sellers cannot sell such items. AG James urged consumers to report any sightings of realistic-looking guns being sold online with shipping options to New York, by filing an online complaint through her office.
This case was handled by Assistant Attorney General Andy Aujla, Deputy Assistant Attorney General Ben Bruce, and Assistant Attorney General Kathryn Martin of the Division of Regional Affairs. Special Counsel Colleen K. Faherty and former Special Counsel Eric Haren also contributed to the investigation.
