Omaha Man Sentenced for Fentanyl Conspiracy

A 27-year-old Omaha man has been sentenced to 60 months in federal prison for his role in a fentanyl conspiracy.

According to court records, Ja’hvont Payne sold over 110 grams of fentanyl, which led to the overdose death of a woman in Omaha. The woman overdosed on a pill sold to her by Payne and his co-defendant, Robert Rush, who is currently scheduled for trial in March 2022.

Law enforcement executed a search warrant on an apartment at 25th and Cumming Streets in Omaha on March 1, 2020, after being notified of the overdose. Inside, they found 1,029 pills in nine different bags, all of which tested positive for fentanyl.

The United States alleges that Rush sold the pill that caused the woman’s overdose, and Payne was staying with him at the time of the search. Payne’s sentence includes four years of supervised release after his release from prison, with no parole available in the federal system.

The investigation into Payne’s activities was conducted by the Omaha Police Department.
