South Dakota Man Convicted of Distributing Fentanyl Resulting in Death

A Sioux Falls man has been convicted of distributing fentanyl that resulted in the death of a woman, according to a recent verdict in federal district court.

Armando Cheshier, 25, was found guilty of Distribution of a Controlled Substance Resulting in Death and two counts of Distribution of a Controlled Substance after a three-day jury trial.

The charges carry a maximum penalty of life in custody and/or a $1,000,000 fine, life on supervised release, and a $300 special assessment to the Federal Crime Victims Fund.

Cheshier was indicted by a federal grand jury in June of 2022 and distributed fentanyl and Xanax to the victim, which ultimately resulted in her death due to the fatal amounts of fentanyl in her system.

According to the U.S. Attorney for the District of South Dakota, Alison J. Ramsdell, “seven out of every ten fentanyl pills contain a lethal dose of this deadly controlled substance.”

Cheshier faces a presentence investigation and a sentencing date has been set for February 9, 2024, at 1:00 p.m. The defendant was remanded to the custody of the U.S. Marshals Service.

The case was investigated by the Sioux Falls Area Drug Task Force and the Drug Enforcement Administration, with Assistant U.S. Attorney Mark Hodges prosecuting the case.

“Two milligrams of fentanyl, small enough to fit on the tip of a pencil, is considered potentially lethal,” said DEA Omaha Division Special Agent in Charge Justin C. King. “We need to raise awareness of the threat this drug poses to our communities if we want to prevent futures deaths such as this one from occurring.”
