Kingstree Man Sentenced for Possession of Stolen Firearm

A 41-year-old man from Kingstree, South Carolina, has been sentenced to 108 months imprisonment for possession of a stolen firearm.

The U.S. Attorney’s Office for the District of South Carolina announced that Brian Burgess, 41, was sentenced yesterday in federal court in Florence, South Carolina, for violating 18 U.S.C. § 922(j) – Possession of a Stolen Firearm.

According to the U.S. Attorney’s Office, Burgess was previously convicted of a felony offense and prohibited from possessing a firearm. On November 4, 2015, officers with the Myrtle Beach Police Department (MBPD) responded to a hotel in Myrtle Beach as part of a heroin overdose investigation. MBPD searched a room in the hotel pursuant to a search warrant and located a stolen 9mm firearm.

Burgess claimed possession of the pistol, and evidence presented at the change of plea on November 28, 2016, and sentencing hearing established that he was in possession of the stolen firearm. Burgess was sentenced to 108 months imprisonment followed by three years of supervised release.
