PIERRE, SD — In a chilling display of justice, Dana James Marshall, 38, from Cherry Creek, South Dakota, was sentenced to five years in federal prison for his heinous act of abusive sexual contact against his 18-year-old niece. The sentence includes a further five years of supervised release and a mandatory payment of $200 to the Federal Crime Victims Fund.
Marshall’s predatory behavior came to light when he invited the young woman into his bedroom on April 15, 2022. Despite her clear refusal, Marshall subjected her to an unwarranted and violent sexual assault. The incident occurred in Cherry Creek Community, situated within the Cheyenne River Indian Reservation.
The case was handled by federal authorities due to the Major Crimes Act, which necessitates that certain crimes committed in Indian country are prosecuted at the federal level rather than state courts. This law ensures a more stringent and appropriate judicial process for victims of such violent acts.
Marshall was indicted by a federal grand jury in October 2023 and entered a guilty plea on March 11, 2024. The investigation into this despicable act was spearheaded by the Cheyenne River Sioux Tribe Law Enforcement Service and the FBI, with Assistant U.S. Attorney Carl Thunem leading the prosecution.
Following his conviction, Marshall was immediately taken into custody by the U.S. Marshals Service to serve his sentence, sending a strong message that such egregious behavior will not be tolerated in our communities.
