David McMurray, a 43-year-old man from Utica, New York, has pleaded guilty to accessing child pornography and violating the conditions of his federal supervised release. The crimes occurred in September 2025, while McMurray was still on supervised release for a 2013 federal conviction related to child pornography. McMurray’s guilty plea was entered on July 8, 2026.
According to the plea agreement, McMurray admitted to accessing websites with the intent to view child pornography, as well as failing to comply with several conditions of his supervised release. These conditions included failing to file monthly reports, failing to submit to a polygraph, and accessing unmonitored internet-capable phones.
The investigation was led by the FBI’s Child Exploitation and Human Trafficking Task Force, with assistance from the New York State Police. First Assistant United States Attorney John A. Sarcone III and FBI Special Agent in Charge Craig L. Tremaroli announced the guilty plea.
McMurray’s decision to violate the conditions of his supervised release and engage in conduct that threatens the safety of children has resulted in a new federal sentence that could place him in prison for up to 20 years. The case highlights the importance of holding offenders accountable for their actions and ensuring that they comply with the conditions of their release.
