Felon Caught with Shotgun, Fentanyl in Elyria
Grimy Times has learned that Demann Wilson, 30, of Elyria, was indicted on one count of being a felon in possession of a firearm and one count of possession with intent to distribute a controlled substance.
According to the indictment, on July 11, Wilson possessed a significant amount of fentanyl and an American Arms 12-gauge shotgun and ammunition. Wilson was prohibited from having the firearm due to previous convictions for drug trafficking, making him a felon in possession of a firearm.
Wilson’s indictment comes after an investigation by the FBI and Elyria Police Department, with Assistant U.S. Attorneys Robert Kolansky handling the prosecution.
In a separate case, Cortezes Diming, 49, of Cleveland, was charged with one count of being a felon in possession of a firearm. Diming possessed a loaded RG Industries .22-caliber pistol on March 13, despite previous convictions for felonious assault, attempted felonious assault, burglary and other crimes, according to the indictment.
The investigation into Diming’s case was conducted by the ATF and the Cleveland Division of Police, with Assistant U.S. Attorney Margaret Kane handling the prosecution.
An indictment is only a charge and is not evidence of guilt. Defendants are entitled to a fair trial in which it will be the government’s burden to prove guilt beyond a reasonable doubt.
If convicted, Wilson and Diming’s sentences will be determined by the Court, taking into account factors unique to this case, including their prior criminal records, their roles in the offense, and the characteristics of the violation. The maximum sentence will not exceed the statutory maximum, and in most cases, it will be less than the maximum.
