A Dayton man is headed to prison after being convicted of possessing a firearm as a convicted felon.
David Pate, 28, of Dayton, was sentenced to 90 months in prison for possessing a firearm after having been convicted of a felony.
The sentence was handed down by U.S. District Judge Thomas M. Rose in U.S. District Court.
According to court documents, on November 2, 2015, Dayton Police started to follow Pate as he operated a vehicle. Pate sped away and crashed into a fence before fleeing on foot. He was ultimately arrested and officers found a semi-automatic pistol under the driver’s seat of his vehicle.
Pate had been convicted of felony offenses in 2009 and 2011, including trafficking in heroin and felonious assault. He pleaded guilty on December 29, 2015 to a Bill of Information charging him with one count of possession of a firearm by a convicted felon.
Acting U.S. Attorney Benjamin C. Glassman commended the cooperative investigation by those involved in the Community Initiative to Reduce Gun Violence, as well as Assistant United States Attorney Andrew Hunt, who is representing the United States in this case.
“This sentence sends a strong message that individuals who possess firearms as convicted felons will face serious consequences,” Acting U.S. Attorney Glassman said.
Dayton Police Chief Richard Biehl also praised the work of the investigative team, saying, “The Community Initiative to Reduce Gun Violence continues to show its effectiveness in reducing gun violence in our community.”
