A Mexican national faces up to 10 years in prison after pleading guilty to re-entry by a removed alien in Louisiana federal court. Pedro Fernandez-Garcia, 40, appeared before U.S. District Judge Sarah S. Vance and admitted to being an alien who had previously been removed from the United States.
According to court documents, Fernandez-Garcia was found in Jefferson Parish, Louisiana on December 5, 2012, without having obtained consent from the Secretary of Homeland Security to reapply for admission to the United States. The indictment charging Fernandez-Garcia with illegal re-entry also included a notice of sentencing enhancement based on his prior felony conviction.
The enhancement carries a maximum statutory penalty of ten years imprisonment, a fine of $250,000, and three years of supervised release following any term of imprisonment. Sentencing for the defendant is scheduled for May 15, 2013 at 9:30 A.M.
The case was investigated by U.S. Immigration and Customs Enforcement (ICE) – Enforcement and Removal Operations. The case is being prosecuted by Special Assistant U.S. Attorney Robert Weir.
