Fernando Herrera-Cruz Charged with Illegal Re-Entry in Missouri

JEFFERSON CITY, Mo. – In a shocking turn of events, Fernando Herrera-Cruz, a 37-year-old Mexican national, has been charged with illegal re-entry in Missouri, according to a federal indictment.

Herrera-Cruz, who was previously removed from the United States on March 30, 2022, is accused of voluntarily re-entering the country without permission. He was found in Camden County, Missouri, on March 18, 2025, after being involved in a single-vehicle accident while driving without a valid driver’s license.

The indictment, which was returned by a federal grand jury this week, charges Herrera-Cruz with illegal re-entry by a previously deported alien. According to the indictment, he has never applied to the Attorney General of the United States and/or the Secretary of the Department of Homeland Security for permission to re-enter the United States.

Herrera-Cruz’s case is part of Operation Take Back America, a nationwide initiative that aims to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime.

ICE Homeland Security Investigations is leading the investigation into Herrera-Cruz’s case. The charges contained in the indictment are simply accusations, and not evidence of guilt. Evidence supporting the charges must be presented to a federal trial jury, whose duty is to determine guilt or innocence.

The U.S. government is taking a tough stance on illegal immigration, and cases like Herrera-Cruz’s are a prime example of the consequences of re-entering the country without permission.
