A Dubuque hospital nurse anesthetist has been sentenced to federal prison for diverting fentanyl for his own use. Ian Lindsey, 42, of Mineral Point, Wisconsin, received a three-month prison sentence after pleading guilty to charges of acquiring a controlled substance by misrepresentation, fraud, deception, and subterfuge, and making a false statement relating to health care matters.
According to court documents, Lindsey diverted significant amounts of fentanyl and other drugs from a hospital in Platteville, Wisconsin, dating back to at least 2017. He also illegally accessed patient records and made false statements in patient records at the Platteville hospital. Lindsey was fired from the Platteville hospital in 2017 due to his conduct.
Lindsey’s criminal conduct resumed at a hospital in Dubuque, Iowa, where he diverted fentanyl from nearly 50 patients between October 2022 and at least January 25, 2023. He also illegally accessed the medical records of six patients and made a false statement in the medical record of another patient.
Lindsey has a serious criminal history dating back to 2004, including four convictions for drunk driving in Wisconsin. He was convicted of a fourth offense operating with prohibited alcohol content in 2024.
Lindsey was sentenced in Cedar Rapids by United States District Court Chief Judge C.J. Williams. He was sentenced to three months’ imprisonment, six months of home confinement, and fined $5,000. He must also serve a three-year term of supervised release after the prison term.
At the sentencing hearing, Chief Judge Williams found Lindsey had committed a ‘gross abuse of trust,’ encouraged Lindsey to stay out of the medical profession, and criticized the relevant licensing boards for not taking action against Lindsey’s nursing licenses over the years.
Lindsey was released on bond and is to surrender to the Bureau of Prisons on a date yet to be set. The case was prosecuted by Assistant United States Attorney Timothy L. Vavricek and investigated by the Iowa Medicaid Fraud Control Unit.
