Lantry Man Charged with Sex Crime

A Lantry, South Dakota, man has been accused of having sexual contact with a minor, according to a federal indictment. Robert Smith, 52, was indicted on September 17, 2013, for Sexual Contact with a Minor.

Smith appeared before U.S. Magistrate Judge Mark A. Moreno on September 19, 2013, and pled not guilty to the indictment. The maximum penalty upon conviction is up to 2 years in custody and/or a $250,000 fine, up to life of supervised release, and a $100 special assessment to the Federal Crime Victims Fund. Restitution may also be ordered.

The alleged sex crime is said to have taken place near Lantry between May 30, 2012, and July 27, 2012. The charge is merely an accusation, and Smith is presumed innocent until and unless proven guilty.

The investigation is being conducted by the Federal Bureau of Investigation and the Cheyenne River Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Mikal Hanson is prosecuting the case.

Smith was released on bond pending trial. A trial date has not been set. The public is urged to report any information regarding this case to the authorities.
