Robert J. Kapishkowit, 26, an enrolled member of the Menominee Indian Tribe of Wisconsin, has been charged with Sexual Abuse of a Minor, a federal offense.
A federal grand jury returned a one-count indictment against Kapishkowit on November 5, 2019, accusing him of engaging in a sex act with a minor on June 11, 2018. The alleged victim was at least 4 years younger than Kapishkowit and had reached the age of 12 but not 16.
The assault allegedly took place within the exterior boundaries of the Menominee Indian Reservation, where Kapishkowit resides in Neopit.
Kapishkowit, if convicted, faces a maximum of 15 years in prison, a fine of up to $250,000, from 5 years to life on supervised release, and a $100 special assessment.
The Menominee Tribal Police Department and Federal Bureau of Investigation investigated the case, which will be prosecuted by Assistant United States Attorney Andrew J. Maier.
Kapishkowit is presumed innocent until proven guilty and is entitled to a fair trial at which the government must prove guilt beyond a reasonable doubt.
The case is a stark reminder of the ongoing issue of child sex abuse within Native American communities and highlights the importance of continued efforts to prevent and prosecute these crimes.
