Felix Missael Alva, Alien Firearm Possession, Colorado 2020

United States Attorney Jason R. Dunn announced the arrest of Felix Missael Alva, a Mexican national and Aurora resident, for being an alien in possession of a firearm during the Denver protests on May 30, 2020.

Dunn revealed that Alva made his initial appearance before being advised of his rights and the charges against him. The Denver ATF and the Denver Police Department were instrumental in this announcement.

The affidavit states that on May 30, a detective observed a male passenger, later identified as Alva, produce a black semi-automatic handgun from a white Jeep during the protests. The individual fired into the air while threatening that it was not a peaceful protest.

Law enforcement executed a search warrant at Alva’s residence on June 4, where they found the firearm and accessories matching those seen in the May shooting.

Alva, who had been deported to Mexico in 2010, was present in the United States illegally at the time of the offense. He is prohibited from possessing weapons due to his illegal status.

The investigation was conducted by the Denver ATF and the Denver Police Department, with Alva being prosecuted by Special Assistant U.S. Attorney Dorothy DiPascali. The case is part of Project Guardian, the DOJ initiative aimed at reducing gun violence and enforcing federal firearms laws.
