Mexican National Indicted for Illegal Re-Entry

A 31-year-old Mexican national has been charged with illegally re-entering the United States, federal authorities announced today.

According to a one-count indictment, Faustino Juarez-Castillo re-entered the country despite being previously deported on October 28, 2011.

The indictment alleges that Juarez-Castillo’s actions constitute a violation of Title 8, United States Code, Section 1326(a), which prohibits aliens who have been previously removed from the United States from re-entering the country without permission.

Prosecutors say that if convicted, Juarez-Castillo could face a maximum term of imprisonment of two years, a maximum fine of $250,000, a maximum term of supervised release of one year, and a mandatory $100 special assessment.

U.S. Attorney Kenneth A. Polite emphasized that an indictment is merely an accusation, and the defendant is presumed innocent until proven guilty beyond a reasonable doubt.

Praise was given to the United States Department of Homeland Security for their work in investigating this matter, with Assistant U.S. Attorney Spiro G. Latsis leading the prosecution.
