ELKINS, WEST VIRGINIA – A Petersburg, West Virginia man, Benjamin Wayne Hyre, 36, was arrested and indicted by a federal grand jury for a litany of firearms violations. The charges include ‘Felon in possession of a firearm,’ ‘Possession of a firearm with altered serial number,’ ‘Unlawful transfer of short barrel firearm,’ and ‘Unlawful possession of a silencer.’ These offenses are alleged to have taken place between March 2016 and December 2016 within Grant County.
Hyre, if convicted on all counts, faces up to ten years in prison and a fine of $250,000 for the first charge, five years and $250,000 for the second, and ten years and $10,000 for each of the third and fourth charges. The actual sentence will depend upon his prior criminal history and the seriousness of the offenses.
The Assistant U.S. Attorney Stephen D. Warner is handling the case against Hyre, who was charged on February 22nd this year. The investigation was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Grant County Sheriff’s Office.
It is important to note that an indictment is merely an accusation, and a defendant is presumed innocent unless proven guilty in court.
