Gary Pourier, a 59-year-old man from Porcupine, South Dakota, has been sentenced to 12 years in federal prison for five charges of Abusive Sexual Contact. The crimes occurred in July 2024, when Pourier sexually fondled a 10-year-old girl at the Common Cents Convenience Store near Porcupine. The victim reported the incident to a guardian, who then notified the authorities. The Oglala Sioux Tribe Department of Public Safety and the Federal Bureau of Investigation (FBI) responded to the scene and launched an investigation, which uncovered additional victims.
Pourier was initially indicted by a federal grand jury in August 2024. As the investigation continued, two more victims came forward, and additional charges were added. The case went to trial in April 2026, with four victims testifying against Pourier. The jury found him guilty on all counts.
The sentencing took place on August 3, 2026, with U.S. District Judge Camela C. Theeler ordering Pourier to serve 12 years in federal prison for each count, followed by five years of supervised release. The sentences will run concurrently. Pourier was also ordered to pay a $500 special assessment to the Federal Crime Victims Fund and a $5,000 special assessment pursuant to the Justice for Victims of Trafficking Act of 2015.
The case was prosecuted by the U.S. Attorney’s Office, with Assistant U.S. Attorney Megan Poppen handling the case. The FBI and the Oglala Sioux Tribe Department of Public Safety investigated the matter. The Major Crimes Act required the case to be prosecuted in federal court, as the crimes occurred in Indian country.
