A 52-year-old sex offender, James Henry Herb, III, relocated from central Pennsylvania to New York, but failed to register his new address as required by law. The incident occurred between December 2025 and April 1, 2026. Herb, now a resident of Elmira, New York, was supposed to register under the Sex Offender Registration and Notification Act (SORNA) but did not comply. The US Marshals Service investigated the case, which was prosecuted by Assistant United States Attorney Alisan V. Martin.
The case is part of Project Safe Childhood, a nationwide initiative launched in May 2006 to combat child sexual exploitation and abuse. The project aims to locate, apprehend, and prosecute individuals who sexually exploit children and rescue victims.
The maximum penalty for failing to register as a sex offender is 10 years of imprisonment, a term of supervised release, and a fine. Herb’s indictment is a result of the federal grand jury’s investigation, and he is presumed innocent unless proven guilty in court.
The US Attorney’s Office for the Middle District of Pennsylvania announced the indictment, highlighting the importance of compliance with SORNA. The law requires sex offenders to register their addresses to ensure public safety and prevent further crimes.
