LAS VEGAS – The grim streets of Las Vegas have once again become the scene of a disturbing repeat performance. Rigoberto Osorio-Merlo, a 49-year-old Honduran national with two prior deportations, faced his first court appearance today for charges related to illegal reentry into the United States.
Osorio-Merlo, who now finds himself embroiled in legal woes, is staring down one-count of deported alien found in the United States. His preliminary hearing is set for December 4, 2025, before Judge Elayna J. Youchah.
The allegations against Osorio-Merlo paint a picture of a man who has ignored the laws of this land with brazen disregard. According to court documents, he was deported not once but twice – on January 15, 2009, and November 14, 2018. He managed to reenter the United States illicitly, only to be caught again this time.
On July 22, 2024, U.S. Immigration and Customs Enforcement (ICE) received a jolt when Las Vegas Metropolitan Police Department officers arrested Osorio-Merlo for Duty to Stop at Scene of Accident, Destroy/Conceal Evidence, and Reckless Driving Resulting in Death or Substantial Bodily Harm. One year later, on July 30, 2025, he was transferred to ICE custody following an immigration detainer.
Osorio-Merlo’s rap sheet is lengthy. He boasts two DUI convictions – one from 2011 and another in 2016. His latest conviction stems from the reckless driving incident in 2024. If found guilty, Osorio-Merlo faces a formidable penalty: up to two years in prison, supervised release for a year, a $250,000 fine, and a $100 special assessment.
The United States Attorney’s Office for the District of Nevada has been on the case, with Acting United States Attorney Sigal Chattah leading the charge. ICE Salt Lake City, Las Vegas Sub-Office investigated, and the public is encouraged to report crimes or suspicious activity by calling 866-DHS-2-ICE (866-347-2423) or completing an online tip form.
