Las Vegas’s gritty streets saw two foreign nationals, Jose Luis Ruiz-Gutierrez and Samir Adrian Hernandez-Padilla, make their initial court appearances this week. Both men, aged 39, are facing one-count charges of illegally reentering the United States after having been previously deported. The case is a stark reminder of the dangers posed by those who ignore immigration laws.
According to court documents, Ruiz-Gutierrez, a Mexican national, and Hernandez-Padilla, from Honduras, had both been booted out of the country before sneaking back in. Ruiz-Gutierrez’s previous transgressions include drug trafficking and a deported alien charge—crimes he is now charged with anew.
The grim details of Ruiz-Gutierrez’s latest arrest came to light on July 23, when he was taken into ICE custody after being booked for four counts of Sex Assault Against Child Less Than 16 and Lewdness by Person Over 18 with Child Less Than 14. The man, who has been deported three times since February 2011, faces a maximum penalty of 20 years in prison if convicted.
Hernandez-Padilla’s case is equally concerning. On July 18, he was remanded to ICE custody after being arrested for Watercraft Driving Under the Influence Resulting in Death, with deportation having taken place on December 12, 2013. If found guilty, Hernandez-Padilla could serve up to two years in prison.
Acting United States Attorney Sigal Chattah and Salt Lake City Field Office Director Jason Knight announced the charges against the defendants. The ICE Salt Lake City, Las Vegas Sub-Office investigated the case, and the United States Attorney’s Office for the District of Nevada is tasked with prosecution.
The public is reminded to report crimes and suspicious activity through 866-DHS-2-ICE (866-347-2423) or by completing the online tip form. As always, a complaint is merely an accusation, and a defendant is presumed innocent unless and until proven guilty.
