Orellana Faces Time for Illegal Re-Entry

NEW ORLEANS, LA – Jose Orellana, 35, a citizen of Honduras, admitted guilt yesterday to a federal charge stemming from his unauthorized return to the United States, according to U.S. Attorney Kenneth A. Polite. Orellana pled guilty to one count of illegal entry of a removed alien, a violation of Title 18, United States Code, Section 1326(a). The case highlights the ongoing struggle to secure the border and enforce immigration laws, even after formal removal proceedings.

Court records detail a clear pattern of disregard for U.S. immigration law. Orellana was initially removed from the country on January 15, 2010 – meaning he was formally deported and barred from legal re-entry. Yet, he resurfaced within our borders on December 1, 2014, in the Eastern District of Louisiana, having obtained no legal permission from either the Attorney General or the Secretary of the Department of Homeland Security to return.

The fact that Orellana knowingly violated a removal order is central to the prosecution’s case. Federal authorities have zero tolerance for individuals who attempt to circumvent the legal immigration process after being explicitly barred from entry. This isn’t simply about crossing a border; it’s about disrespecting the rule of law and potentially jeopardizing national security.

Orellana now faces a harsh reckoning. He is looking at a maximum sentence of two years behind bars, alongside a hefty fine of $250,000. The sentence will be handed down by United States District Court Judge Ivan L.R. Lemelle on April 8, 2015. The Grimy Times will be present for the sentencing, providing a full account of the outcome.

U.S. Attorney Polite was quick to commend the diligent work of the U.S. Customs and Border Protection agency in uncovering and investigating this case. Their efforts are critical in identifying and apprehending those who attempt to exploit vulnerabilities in the immigration system. The prosecution is being handled by Assistant United States Attorney Jon Maestri.

This case serves as a stark reminder that violating federal immigration laws carries serious consequences. While debates rage about immigration reform, the courts will continue to enforce existing laws, holding accountable those who choose to ignore them. The Grimy Times will continue to follow this story and report on all federal crime happening in Louisiana and beyond.
