Abusive Sexual Contact on a Flight Leads to 1-Year Prison Sentence
A disturbing incident on a commercial aircraft has resulted in a 1-year prison sentence for Ian Wagner, 39, of New Haven, Indiana. Wagner was sentenced by United States District Judge John M. Gerrard in Lincoln, Nebraska, on [undisclosed date].
The incident occurred on October 6, 2017, when Wagner was seated next to an 18-year-old woman on a domestic flight from Indianapolis to Denver. The woman fell asleep, and later, Wagner rubbed her inner thigh with his hand. She took a photograph of him, which included geolocation data indicating the plane was flying over Hastings, Nebraska.
The victim then left her seat and sought refuge in the airplane’s lavatory but eventually returned, believing the flight was full. After retaking her seat, she observed Wagner placing a jacket over his lap and his hand moving up and down under the jacket. Wagner made eye contact with the victim and lifted his jacket, exposing his penis. For over five minutes, Wagner masturbated while staring at the victim.
Frightened and troubled by the incident, the victim lodged a complaint with the airline two days later and with criminal authorities in the following weeks. This case was investigated by the Federal Bureau of Investigation.
Wagner was sentenced to 1 year and 6 months in prison and 6 years of supervised release with special conditions. He was also ordered to pay $500 in restitution to the victim. There is no parole in the federal system.
According to the U.S. Attorney’s office, abusive sexual contact of an incapacitated person is a serious offense that will be prosecuted to the fullest extent of the law. The case serves as a reminder of the importance of reporting such incidents and the consequences of committing such crimes.
