Atoka Couple Convicted of Stealing Government Funds
MUSKOGEE, OKLAHOMA – In a shocking turn of events, a federal jury has found Michael Ferrarie Eubanks, 57, and Hydie Roylene Eubanks, 58, both of Atoka, Oklahoma, guilty of theft of government funds, concealment of a material fact, and false statement.
The verdict, handed down on February 23, 2017, marks the end of a lengthy investigation by the Social Security Administration’s Office of Inspector General. According to court documents, the Eubanks couple embezzled over $67,633 in Social Security disability payments between September 2010 and March 10, 2016.
Prosecutors allege that the couple knowingly and willfully converted the funds to their own use, despite knowing that Michael Ferrarie Eubanks was not entitled to the payments. The couple also concealed their gainful employment in order to continue receiving the disability payments.
The investigation revealed that the Eubanks couple completed a Continuing Disability Review Report in which they falsely stated that Michael Ferrarie Eubanks had not worked since his last medical disability determination. This false statement was made in order to continue receiving the disability payments.
The guilty verdict was the result of a trial that began on February 21, 2017, and concluded on February 23, 2017. Assistant United States Attorneys Melody Nelson and Rob Wallace represented the United States in the case.
The defendants will remain out on bond pending sentencing. A presentence report will be completed, and sentencing will be scheduled at a later date. The case is a stark reminder of the importance of accountability and the consequences of stealing from government programs.
