Eugene Gosy, Opioid Distribution, New York 2006

A 55-year-old pain doctor from Clarence, NY, has been accused of fueling the opioid epidemic in Western New York. Dr. Eugene Gosy, 55, was indicted on 114 counts, including conspiracy to distribute controlled substances, unlawful distribution of narcotics, and health care fraud.

The indictment alleges that between 2006 and the present, Gosy distributed hundreds of thousands of prescriptions for controlled substances, including fentanyl, oxycodone, morphine, and hydrocodone, for reasons other than legitimate medical purposes. The prescriptions were allegedly issued in exchange for payments from patients and insurance companies.

According to the indictment, Gosy’s clinic operated outside of accepted medical practice, with methods including issuing prescriptions to patients who were obvious abusers, falsifying training requirements, and signing blank prescriptions for unqualified staff to fill out.

U.S. Attorney William J. Hochul Jr. called Gosy’s actions a ‘sophisticated criminal enterprise’ that turned patients into dependents and fueled the opioid epidemic.

Drug Enforcement Administration Special Agent in Charge James J. Hunt compared Gosy’s clinic to 19th Century opium dens, stating that Gosy prescribed millions of pills for no legitimate medical purpose in exchange for profit.

FBI Special Agent in Charge Adam S. Cohen called Gosy’s actions ‘arrogant’ and stated that doctors like Gosy should work to heal the sick, not increase their patients’ pain and suffering for personal gain.

The case is being handled by Assistant U.S. Attorneys George C. Burgasser and Elizabeth R. Moellering, who stated that the indictment carries a maximum penalty of 20 years and a $1,000,000 fine.
