New York – Amidst the chaos of Winter Storm Fern and the looming threat of further inclement weather, New York Attorney General Letitia James has issued a dire consumer alert. The alert underscores the importance of travelers understanding their rights in the face of widespread flight disruptions.
Attorney General James emphasized that while winter storms are unpredictable, passengers’ rights are not: ‘If your flight is canceled or significantly delayed, you may be entitled to a refund,’ she said. Airlines must comply with the law, ensuring New Yorkers receive fair treatment and the refunds they deserve.
Winter Storm Fern has already caused thousands of cancellations at major airports across the nation, including those serving New York City. With more winter storms on the horizon, Attorney General James reminds passengers to take action: ‘File complaints online,’ she advised, ‘to potentially receive compensation if your travel plans are disrupted.’
Passengers have a right to full refunds within 24 hours of ticket purchase for tickets bought more than seven days in advance. Discount fares are generally non-refundable. Additionally, travelers may seek refunds if an airline cancels their flight and opts not to accept compensation offered by the airline.
Airlines must adhere to promises made in customer service plans, including commitments during delays or cancellations. The Department of Transportation’s (DOT) airline cancelation and delay dashboard provides information on amenities and compensation committed to passengers.
For overbooked flights, travelers bumped from the plane may be eligible for compensation and a written statement detailing their rights. In cases of lost checked luggage, refunds are due under specific conditions, including delays in baggage delivery.
