Calvin Bernhardt Guilty in Child Porn, Witness Tampering Case

Calvin Bernhardt, 54, of Tuttle, North Dakota, was found guilty on October 31, 2016, after a grueling four-day trial that exposed a calculated campaign of sexual predation spanning international borders. Bernhardt faces sentencing on charges of Attempted Sexual Exploitation of a Minor, Attempted Receipt of Materials Depicting the Sexual Exploitation of a Minor, Counterfeit Currency, Tampering with Witness or Evidence, and Attempted Travel with Intent to Engage in Sexual Acts with a Minor.

The crimes unfolded between September 2015 and March 2016, when Bernhardt used the internet to target and manipulate a 14-year-old girl in the Philippines. Through direct communication, he coerced her into producing and transmitting sexually explicit and sadomasochistic images. Federal prosecutors detailed how Bernhardt escalated his demands, grooming the minor over digital channels while concealing his identity and intentions from her family and local authorities.

When Bernhardt learned of an active U.S. investigation, he didn’t back down—he doubled down on deception. He contacted the victim’s mother in the Philippines and ordered her to delete all incriminating images from the girl’s cellphone. He also instructed her to remain silent if approached by U.S. federal agents operating in the country. These actions led directly to the witness tampering charge, underscoring a deliberate effort to obstruct justice.

Texts and digital records recovered by investigators revealed Bernhardt was actively planning to meet the minor at a hotel in the Philippines, with the clear intent of engaging in sexual acts. The communications painted a damning picture of premeditated exploitation, showing Bernhardt discussing travel logistics and using manipulative language to keep the girl compliant. His digital footprint left a trail federal agents followed from Bismarck to Manila.

“The United States and the District of North Dakota will not tolerate this kind of conduct and victimization of children over the internet regardless of where the victim is located,” said Assistant U.S. Attorney Gary Delorme. “People engaging in this kind of conduct should expect to be vigorously prosecuted in this District.” The statement underscored the DOJ’s aggressive stance against transnational child exploitation.

The case was jointly investigated by Department of Homeland Security-Homeland Security Investigations in Bismarck, HSI operatives in Manila, Philippines, and the North Dakota Bureau of Criminal Investigation. Assistant U.S. Attorneys Gary Delorme and Jon O’Konek led the prosecution, ensuring Bernhardt was held accountable for each facet of his criminal enterprise—from digital coercion to international obstruction of justice.
