Shane Millan Sentenced for Rights Violation at Border

SYRACUSE, NEW YORK – Shane Millan, 53, of Jefferson County, New York, is staring down a year in federal prison after pleading guilty to two misdemeanor counts of deprivation of rights under color of law. This stunning revelation has cast a long shadow over the U.S. Border Patrol.

Millan’s crimes were exposed when he coerced victims into exposing their bare chests during virtual processing for admission into the United States. He falsely claimed that such searches were part of legal protocol, but authorities have since charged him with using his position as an agent to satisfy personal desires.

Acting United States Attorney John A. Sarcone III and Special Agent in Charge Vance Kuhner of U.S. Customs and Border Protection’s Office of Professional Responsibility jointly announced the sentence. ‘Everybody deserves respect, and we will not tolerate the sexual exploitation of immigrants by members of law enforcement,’ Sarcone stated. ‘Nobody is above the law.’

Special Agent Kuhner echoed these sentiments, emphasizing that CBP holds its employees to the highest standards and does not condone violations of oath or citizen rights. ‘The actions of this ex-U.S. Border Patrol agent are deeply troubling and do not reflect the values of the Border Patrol,’ he said.

In his plea, Millan admitted to willfully depriving victims of their constitutional right to be free from unreasonable searches. The U.S. Customs and Border Protection Office of Professional Responsibility Investigative Operations Directorate is currently investigating the case further, with Assistant U.S. Attorneys Michael F. Perry and Michael D. Gadarian handling the prosecution.
