Repeat Offender Sajcap-Agreda Jailed for Illegal Re-Entry

CEDAR RAPIDS, IA – Victor Sajcap-Agreda, a 40-year-old Guatemalan national, is behind bars after receiving a 90-day federal prison sentence for the crime of illegally re-entering the United States. The sentence was handed down by United States District Court Judge C.J. Williams, solidifying the consequences for flouting immigration law.

Sajcap-Agreda, residing in Allamakee County, Iowa, pled guilty on July 15, 2020, to one count of illegal reentry. Court records reveal he previously faced deportation in March 2014 following a misdemeanor conviction for illegal entry in the Southern District of Texas. Despite being removed from the country, Sajcap-Agreda chose to return unlawfully, bypassing any legitimate avenues for re-entry.

The case against Sajcap-Agreda resurfaced following an arrest on May 31, 2020, again in Allamakee County. He was taken into custody on charges of operating a motor vehicle while under the influence of alcohol – charges that remain pending. This latest incident brought him to the attention of Immigration and Customs Enforcement (ICE), triggering the federal prosecution for his unlawful presence.

Assistant United States Attorney Daniel C. Tvedt successfully prosecuted the case, backed by an investigation conducted by ICE’s Enforcement and Removal Operations. Sajcap-Agreda will serve a one-year term of supervised release following his 90-day imprisonment. Unlike state systems, there is no parole in the federal system, meaning Sajcap-Agreda will serve his full sentence before being released under supervision.

Currently held in the custody of the United States Marshals, Sajcap-Agreda will ultimately be turned over to immigration officials for further processing and potential removal from the United States. This case underscores the federal government’s commitment to enforcing immigration laws and holding accountable those who repeatedly violate them.
