Rosales Gets Time Served for Illegal Return

NEW ORLEANS, LOUISIANA – Carlos Masariego Rosales, a 48-year-old Honduran national, walked out of court with a slap on the wrist after admitting to knowingly violating federal law. Rosales was sentenced on July 22, 2025, for illegal re-entry of a removed alien, a violation of Title 8, United States Code, Section 1326(a). The case highlights the ongoing struggle to control the border and the consequences – or lack thereof – for those who repeatedly skirt the system.

Court documents reveal Rosales was apprehended in Jefferson Parish around March 30, 2025. This wasn’t his first run-in with U.S. immigration authorities. He’d been previously deported back to Honduras on November 20, 2006, making his presence in the States a clear federal offense. Despite the serious nature of the charge, Chief United States District Judge Wendy B. Vitter handed down a lenient sentence: time served and one year of supervised release.

The feds aren’t exactly thrilled with the outcome. Acting United States Attorney Michael M. Simpson, while announcing the sentence, framed the case within the broader context of “Operation Take Back America” – a sweeping initiative designed to combat illegal immigration and dismantle transnational criminal organizations. It’s a lofty goal, but some critics question whether light sentences like this one actually deter future violations.

Operation Take Back America, according to the Department of Justice, aims to “repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime.” The operation pools resources from the Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood. Whether this strategy is effectively addressing the root causes of illegal immigration remains a point of contention.

While Rosales avoids significant jail time, he’s still on the hook for a $100 mandatory special assessment fee. Immigration and Customs Enforcement (ICE) played a key role in building the case, and Simpson praised their investigative work. Assistant United States Attorney Paul J. Hubbell, of the General Crimes Unit, handled the prosecution, navigating the complexities of immigration law and federal sentencing guidelines.

The lenient sentence raises questions about the effectiveness of current immigration enforcement policies. Is time served a sufficient deterrent for someone who has already been deported? Or does it simply perpetuate a cycle of illegal entry and minimal consequences?
